LITIGATION STAFF ATTORNEY

|Description:||HART is currently accepting applications for a Litigation Staff Attorney. The litigation staff attorney represents HART in various civil and administrative forums, including all courts of competent jurisdiction, contract and grievance arbitration hearings, mediations and in all administrative agencies. Practice areas will focus primarily on general liability claims arising from personal injury and property damage, workers compensation claims, and some employment and labor litigation This position may also handle defense of agency charges of discrimination, lawsuits involving a broad range of employment related claims and advice and counsel involving similar issues. From time to time, this position will, on behalf of the agency prosecute or defend commercial litigation matters. The litigation staff attorney reports to the Senior Director of Human Resources, Risk and Legal Services. The litigation staff attorney supervises one paralegal.|
|Duties:|| Handles independent caseload representing HART in all forums whether in the courts or before administrative agencies, from case inception or filing through case disposition including appeal.|
Represents HART in all court matters including drafting pleadings, discovery, including depositions, motion practice, bench and jury trials and appeals.
Researches thoroughly all case and legal precedent that informs HARTs case management strategy.
Formulates strategy in defense or prosecution of cases by interviewing witnesses and investigating case facts.
Writes and prepares all pleadings, formal and informal legal opinions, memorandums and correspondence in plain English in a persuasive or objective active tone, depending on the type of document.
Analyzes liability exposure, summarizes cases, prepares case exposure memorandums, presents exposure analyses to the Senior Director, the Claims Committee and Senior Management.
Negotiates case settlements following analysis of liability.
Representation of HART on active workers compensation claims and litigation matters regarding compensability.
Works closely with Risk Management and Human Resources to minimize employer liability in workers compensation and employment law matters.
Assists in trending and forecasting employee liability areas to minimize employer liability in workers compensation and employment law matters.
Prosecutes and defends contract and grievance arbitration matters.
Provides legal advice and counsel to Authority Boards, committees, task forces and other groups on risk avoidance, and confidentially briefs senior management staff.
Works with or supervises work of contracted outside counsel on Agency matters.
Supervises work of paralegal.
Performs all other work related duties as assigned.
|Qualifications:|| Juris Doctor degree from an ABA-accredited law school.|
Member in good standing of The Florida Bar.
Strong research skills using online research software.
Strong writing skills, preferably in plain English.
Strong advocacy and persuasion skills resulting from litigation practice.
Strong interpersonal and communication skills.
Demonstrated litigation and/or arbitration work experience in a law firm, corporation, or agency, or public entity.
Reputation for high ethical standards and integrity.
Strong analytical skills and ability to exercise sound business judgment and work independently, but as a member of an integrated legal team.
Four (4) to seven (7) years of progressive litigation and first chair trial experience.
Strong skills in all Microsoft Office software, including but not limited to Outlook, Word, Excel, PowerPoint, Publisher, Access and Vizio.
Valid Florida drivers license.
